Terms and Conditions of Service

These Terms and Conditions (“Terms”) govern all services provided by EU Pacific Express Delivery (“Company,” “we,” “us,” or “our”) to any customer, shipper, consignee, or other party (“Customer,” “you,” or “your”). By requesting, booking, or using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.


1. Scope of Services

EU Pacific Express Delivery provides logistics, freight forwarding, transportation, warehousing, customs coordination, and related services by air, land (road and rail), and sea. Services may include but are not limited to pickup, consolidation, packaging, storage, documentation handling, customs facilitation, shipment tracking, and delivery.

All services are provided subject to these Terms, which apply unless otherwise agreed in writing.


2. Acceptance of Terms

By tendering goods to EU Pacific Express Delivery, or by authorizing us to arrange transportation or logistics services, the Customer expressly agrees to these Terms. Any conflicting or additional terms proposed by the Customer are rejected unless expressly accepted in writing by the Company.


3. Customer Responsibilities

3.1 Accurate Information

The Customer is responsible for providing complete, accurate, and lawful information regarding:

  • Nature of goods

  • Weight, dimensions, and quantity

  • Declared value

  • Destination and consignee details

  • Required documentation and permits

EU Pacific Express Delivery is not liable for delays, losses, penalties, or damages resulting from incorrect or incomplete information.

3.2 Compliance With Laws

The Customer warrants that all shipments comply with applicable local, national, and international laws, including customs, export control, sanctions, and safety regulations.

3.3 Proper Packaging

The Customer is responsible for ensuring goods are properly packed, labeled, and prepared for transportation, unless packaging services are expressly provided by the Company.


4. Prohibited and Restricted Goods

The following items are prohibited unless explicitly approved in writing:

  • Illegal goods

  • Counterfeit items

  • Weapons, explosives, or ammunition

  • Narcotics or controlled substances

  • Hazardous materials not properly declared

  • Items prohibited by destination country laws

EU Pacific Express Delivery reserves the right to refuse, hold, inspect, or dispose of prohibited or misdeclared goods without liability.


5. Inspection Rights

EU Pacific Express Delivery reserves the right, but not the obligation, to inspect shipments at any time, with or without notice, to ensure compliance with these Terms, safety standards, and legal requirements.

Inspection does not constitute acceptance of liability or guarantee of shipment condition.


6. Pricing, Charges, and Payment

6.1 Rates

Rates are based on shipment details provided by the Customer and are subject to adjustment if actual shipment characteristics differ.

6.2 Additional Charges

The Customer agrees to pay all applicable charges, including but not limited to:

  • Fuel surcharges

  • Customs duties and taxes

  • Storage fees

  • Demurrage and detention

  • Special handling fees

  • Insurance premiums (if applicable)

6.3 Payment Terms

Unless otherwise agreed in writing:

  • Invoices are payable within the stated period

  • Late payments may incur interest and collection costs

  • EU Pacific Express Delivery may suspend services for non-payment


7. Insurance

7.1 Optional Cargo Insurance

Cargo insurance is not automatically included unless explicitly requested and confirmed in writing. Where insurance is arranged, coverage is subject to insurer terms and exclusions.

7.2 Uninsured Shipments

If insurance is declined or not requested, shipments move at the Customer’s sole risk, subject to the Company’s limited liability as outlined below.


8. Liability and Limitation of Liability

8.1 Standard of Care

EU Pacific Express Delivery shall exercise reasonable care in the performance of its services but does not guarantee delivery times or outcomes.

8.2 Limitation of Liability

To the maximum extent permitted by law, the Company’s liability for loss, damage, or delay is limited to the lesser of:

  • The actual value of the goods, or

  • The applicable international convention limit, or

  • A fixed monetary amount per kilogram or shipment, as applicable

8.3 Excluded Damages

Under no circumstances shall EU Pacific Express Delivery be liable for:

  • Indirect or consequential damages

  • Loss of profits or business

  • Market loss

  • Delay-related economic loss


9. Force Majeure

EU Pacific Express Delivery shall not be liable for failure or delay caused by events beyond its reasonable control, including but not limited to:

  • Natural disasters

  • Acts of war or terrorism

  • Strikes or labor disputes

  • Government actions or embargoes

  • Port congestion or carrier failures

  • Pandemics or public health emergencies


10. Transit Times and Delivery

All transit times provided are estimates only. EU Pacific Express Delivery does not guarantee delivery dates or times unless explicitly agreed in writing.

Delays caused by customs inspections, regulatory actions, weather conditions, or third-party carriers are outside the Company’s control.


11. Third-Party Carriers and Agents

EU Pacific Express Delivery may engage third-party carriers, subcontractors, or agents to perform part or all of the services. These parties operate under their own terms and limitations.

The Company acts as an agent where applicable and is not responsible for acts or omissions of third-party service providers beyond applicable legal limits.


12. Claims and Notices

12.1 Notice of Claims

Any claim for loss, damage, or delay must be submitted in writing within the applicable statutory or contractual period.

Failure to submit timely notice may result in denial of the claim.

12.2 Documentation

Claims must be supported by appropriate documentation, including proof of value, condition, and loss.


13. Storage and Disposal of Goods

If delivery cannot be completed due to Customer action or inaction, EU Pacific Express Delivery may store goods at the Customer’s expense or arrange disposal, sale, or return without liability.

Proceeds from any sale may be applied to outstanding charges.


14. Right of Lien

EU Pacific Express Delivery has a general and continuing lien on all goods and documents for unpaid charges. The Company may retain, sell, or otherwise dispose of goods to recover amounts owed.


15. Confidentiality

All commercial, pricing, and operational information exchanged between the parties shall be treated as confidential, unless disclosure is required by law or regulatory authority.


16. Data Protection and Privacy

EU Pacific Express Delivery processes personal and commercial data solely for the purpose of providing logistics services and in accordance with applicable data protection laws.

By using our services, the Customer consents to such processing.


17. Intellectual Property

All trademarks, logos, service marks, and content related to EU Pacific Express Delivery remain the exclusive property of the Company and may not be used without prior written consent.


18. Termination of Services

EU Pacific Express Delivery reserves the right to refuse or terminate services without notice if:

  • The Customer breaches these Terms

  • Payment obligations are not met

  • Shipments pose legal, safety, or reputational risk

Outstanding obligations shall survive termination.


19. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the applicable operating jurisdiction of EU Pacific Express Delivery. Any disputes shall be subject to the exclusive jurisdiction of competent courts or agreed arbitration forums.


20. Amendments

EU Pacific Express Delivery reserves the right to amend these Terms at any time. Updated Terms shall apply to all services provided after the effective date.


21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.


22. Entire Agreement

These Terms constitute the entire agreement between the Customer and EU Pacific Express Delivery with respect to the services provided and supersede all prior agreements or understandings.
